In order to comply with our legal obligations to provide information and clarification, we inform you hereinafter about how we, Watch Shot UG (UG means a company with limited liability by German law), process your data when you use this application and what rights you have with regard to data processing.

This declaration serves to inform and explain which data is collected, processed or stored when using this application and how we intend to ensure the protection of your individual and personal data. The German data protection regulations, e.g. the BDSG (German Data Protection Law), but also European data protection regulations, e.g. the GDPR, are applicable for the handling of the data collected, processed and stored when using this application.

2 Collection and storage of personal data as well as type and purpose of their use when using this application

2.1 Storage of data when accessing the website

This application collects and stores information transmitted by your browser for technical reasons. The kind of information is depending on the settings of the browser you are using. Transmitted information can be, for example:

  • Browser type,
  • browser version,
  • operating system used,
  • Referrer URL (indicates the website from which you arrived at this website),
  • Host name of the accessing computer (IP address),
  • Name and URL of the retrieved file,
  • time of the server request (timestamp).

A comparison with other data in order to carry out an identification or profiling does not take place. This information is temporarily stored in a so-called log file. The stored data is deleted after 21 days at the latest.

The aforementioned data is processed by us for the following purposes

  • Ensuring a smooth connection setup of the application,
  • Ensuring a comfortable use of the application,
  • Control the load on the servers,
  • Detection of illegal attacks on the servers on which the application is hosted,
  • evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f GDPR. Our legitimate interest follows from the data collection purposes listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

2.4 Deletion of data according to 2.2 and 2.3

The data collected, stored and/or processed by us will be deleted or restricted in its processing in accordance with the provisions of Art. 17 GDPR and Art. 18 GDPR. The data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any mandatory retention obligations.

If data is not deleted because it is required for other and legally permissible purposes, its processing is restricted. I.e. the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for reasons of commercial or tax law.

According to the requirements of the German legislator, data must be stored for 6 years in accordance with § 257 para. 1 HGB (German Commercial Code) e.g.commercial letters, accounting vouchers, opening balance sheets, annual financial statements, … and for 10 years in accordance with § 147 para. 1 AO (General German Tay Code) e.g. commercial letters, business letters, books, records, any documents relevant for taxation, …. The standard limitation period for claims under civil law is three years according to § 195 BGB (German Civil Code), whereby the limitation period begins at the end of the calendar year in which the claim arose and the creditor of the claim became aware of the facts giving rise to the claim and the person of the debtor or should have become aware without gross negligence (§ 199 BGB).

3. Data subject rights

You have the right

  • to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • in accordance with Art. 16 GDPR, to demand the immediate rectification of inaccurate or incomplete personal data stored by us;
  • in accordance with Article 17 GDPR, to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;
  • in accordance with Art. 18 GDPR, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims or you have objected to the processing in accordance with Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller;
  • revoke your consent at any time in accordance with Art. 7 (3) GDPR. This has the consequence that we may no longer continue the data processing based on this consent in the future; and
  • complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our registered office for this purpose.

4. Right of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

We use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties. This data protection declaration is currently valid and has the status October 2020. Due to the further development of our website and offers on it or due to changed legal or official requirements, it may become necessary to change this privacy policy.
